NIL and Title IX

This is a memo of understanding from the dept of education so is not binding. Supreme court already has ruled that ambiguous law can't be settled by a memo of understanding. Since there was no NIL or revenue sharing when the law including title ix was written, the law doesn't cleanly cover it. It can be easily changed with a new memo of understanding to not depend on title ix. Going forward, congress or Supreme court will need to settle it.

Honestly at the high school level, team issues - jealousy, parent issues, etc. There's already so much drama in high school sports, from parents campaigning for their kids, because you know their kid is the best, to coaches playing the kids with the right last name due to town politics, etc. I doubt this will happen at the Class B or C level, who deal with co-oped sports more, which also creates drama. I do appreciate the controls they've put in place as you mentioned. I just see it as a great way to destroy team comeraderie. Hopefully I'm wrong, and likely it will be a small number of kids at the Class AA level that get this type of attention.

Did Montana ever ban NIL in high school? I had a high school athlete graduate a couple years ago & I don't ever remember there bing any sort of NIL restrictions on him or his teammates.

No idea. But they just approved it this week, so guessing if it existed it wasn't "official."

Remember as well that NIL isn't just free money given to players, but compensation for using a players name and image in some way. To me at the high school level, this would be something like a local restaurant paying a kid a couple hundred bucks to appear in a local TV ad. Maybe NIL would add to the normal level of small-town drama that already exists if Player A was hired for an ad but Player B wasn't, or maybe it would be fine. There's an ad that plays during MSU basketball game that features a few of the women's basketball players that I'm sure they received NIL compensation for...if anyone has seen it, you'll probably agree with me that their basketball talent is definitely a few steps up from their acting talent.

Part of the ruling also allowed receipt of gifts up to $500 per year. That would be things like playing in a star games after season and getting a shirt. That has not been allowed.

Yeah I like their basketball talent but in that commercial their acting talent is almost cringe worthy but that almost helps the ad be more effective. Most of the blame should go to the writer and director of the ad.
